ABOUT OUR TERMS & CONDITIONS

Village England is the trading name of E & J Industries Ltd (“Village England”, “we”, “us”, “our”).  We respect the privacy rights of our online visitors (“you”, “your”, “yours”) and recognize the importance of protecting the information collected about them.

E & J Industries Ltd t/a Village England is the sole owner of the information collected on this Website (Site). We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement.

SHOPPING WITH US

Payment

By submitting an order to us via our website, you warrant and confirm that the payment details on the order are valid and correct and that when your order is accepted and processed by us, payment will be made in full.  By placing an order you confirm that you are the person referred to in the Billing Details. 

All payment is processed in GBP. We accept most major cards including Visa, MasterCard, Visa Delta and Visa Electron.  All our credit / debit card transactions are processed using Sagepay, who provide the secure link between our online shop and our bank to ensure that your card details are kept secure and various fraud checks can take place.

We cannot accept payment via cheque, PayPal or any method other than those listed above. The description of the goods, services, price, currency and delivery costs are set out on the order page. Orders shall be accepted at our sole discretion but are normally accepted once credit card authorization has been confirmed, the order reflects current pricing, stock levels have been checked, or in the case of services, we can offer the service you require. To protect our customers from fraudulent credit card use, all orders are subject to security screening and if any irregularities are found, the order may not be processed.

The actual price charged to non-UK customers will be paid in pounds sterling and is subject to the exchange rate applied by the customer’s credit or debit card Company.

PRODUCTS, PRICING AND PROMOTIONS

Product Availability

All products for sale on VillageEngland.com are subject to availability; if for any reason your order cannot be fulfilled owing to lack of stock, you will be advised by email.

Product Descriptions

Every product is sold subject to the product description and supporting information such as size, colour, estimated delivery dates and guarantees. The weights, dimensions and capacities given are approximate only. While we have taken every care to ensure that prices quoted are accurate at the time of posting and products are fairly described, we reserve the right to not accept your order if there is a material errors in the prices or the description of products.  We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, the actual colours you see will depend on your computer equipment, and as such we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the product on delivery.

Prices

All prices include VAT (where applicable) and are subject to change without prior notice.

We ship to all countries outside of the EU on a DDU basis (Delivery Duty Unpaid). This means the recipient will be liable for any local sales taxes or import duties which may be charged on the purchase. Occasionally goods may be subject to delays, due to customs or weather. The customer is responsible for providing any information and payment required by customs to ensure the goods are cleared.

Village England cannot be held responsible for the actions of local customs. See Delivery Outside the EU.

Promotions

We run promotions both in partnership with our stockists and on www.VillageEngland.com. Some of these promotions may be exclusively online promotions or may be exclusively in-store promotions, or may only be available to customers in certain stores.

Where promotional percentage discounts are applied to orders, the discount will be applied to each item in the basket. In the event of a return, you will not be refunded the discounted proportion.

Promotional codes cannot be used in conjunction with any other promotion unless stated.

Unless otherwise stated, discounts are only applicable to full price items (sale and clearance items are not included).   Please note that new season products and limited edition products are excluded from all promotions/discounts unless explicitly stated.

Promotional codes cannot be applied retrospectively to previous orders and are valid for one transaction per person.

Other exclusions may apply and you should always refer to the original source of the promotion/offer for this information.

Online promotions may not be available for orders registered to a non-UK address.

ORDERS AND RETURNS

Placing an Order

Making a purchase is easy. Just follow these simple steps: Browse our range, Click on the image to view more information on size, colour options and availability, Click the “Add to Basket” button on either the Product Grid or on the Product Page, Review the items you have chosen in your shopping bag, or at the checkout. To delete an item from your shopping bag, click on the “Remove” button next to the item.

You can continue shopping by selecting the “Continue Shopping” button.

You can also view the items in your basket whilst you continue shopping, by clicking on the “Shopping Basket” icon at the top of the homepage.

Please be advised that placing an item in your basket does not secure it for you and it can still be purchased by another customer. We therefore suggest that you complete your order as soon as possible.

If entering a promotional code, please ensure you click ‘apply code’’ in order to action the code.   Click “Proceed to Checkout” when you are ready to make your purchase.

You will then be directed to our secure checkout where you will be shown a summary of your purchase including any applicable VAT and delivery charges.  You will then be required to submit your billing and delivery addresses, and details of your payment method. 

Once you have entered this information you will be asked to accept our Terms and Conditions and submit your order by clicking “Place Order”.  Your order will then be security checked and if successful processed.  You will also receive an order confirmation email with details of your order shortly after we have received it.  Please check and retain a copy of this email as it will contain your order reference number which you may need at a later date. By placing an order with E&J Industries Ltd t/a Village England you authorise us to perform a series of information checks to authenticate you identity, to validate your payment card, to obtain an initial credit authorization.  Where necessary we will check your information provided with secure third parties.

Security Checking

All orders placed with E&J Industries Ltd t/a Village England undergo security checking to ensure that the payment card is being used by the card holder and to prevent online fraud occurring.  Please ensure that the billing address entered during checkout is the address where the card statement is also sent.  Should you wish, you will be able to nominate a different address for delivery during the checkout process.

At Village England we are committed to protecting your privacy and meeting the requirements of the Data Protection Legislation.  When you shop on VillageEngland.com we require certain information to process your order, ensure safe and secure delivery and to make your experience more enjoyable.

When you order we will ask for a name, email address, delivery address and telephone number that will be passed on to our couriers in the event they need 

 to contact you regarding the delivery. As all our credit / debit card transactions are processed using Sagepay, we have not access to, and we do not hold any details of your debit/credit card number, CSV code nor the card expiry date. We may also obtain and use information about you as a result of authorization or identity checks (including your IP address).

Amending your order

You are able to correct errors on your order up to the point at which you click on ‘Place Order’ on the Payment Page of our ordering process.

Unfortunately we are unable to amend/change orders once they have been submitted. Therefore if you are unhappy with your order details you will be required to cancel your original order and place a new order with the correct details. You may find there are changes to your delivery timescale and/or the price you pay for the item as you’ll be charged the current selling price on the day you amend or cancel the order.

Acknowledgment and Despatch/Acceptance of your Order

We will notify you by email as soon as possible to acknowledge receipt of your order, so please ensure you enter a valid email address. This does not constitute acceptance of your order, however you must check the details contained within this acknowledgement and notify us of any errors or omissions. Village England reserves the right to refuse an order for any reason. You will be notified of the dispatch of your order by email with the courier details. Notification of dispatch constitutes acceptance of your order. Acceptance of all orders is subject to credit checks and Village England reserve the right to cancel any order which does not comply with these regulations.

Purchases made on our website are for the personal or gift use of the buyer only and are not to be used for re-sale, commercial purposes or any other commercial benefit. Village England reserves the right to restrict multiple quantities of an item being shipped to any one customer or postal address.

Order Cancellation

You have the right under the Distance Selling Regulations to cancel your order within seven working days of receiving your product.  To cancel your entire order, you must notify us in writing to either [email protected] or to Notice of Contract Cancellations, E & J Industries Ltd t/a Village England, 37 Warren St London W1T 6AD within seven days of receiving your order.  Upon receipt of your notice of contract cancellation, our customer care department will email you a Returns Merchandise Autorisation (RMA) number.  Please complete this on the returns pro forma invoice that you received with your order, and include it with your return so that we can process your refund promptly.  Please package the goods securely and return them to us within 28 days of the goods being delivered to you.  All returns must be in perfect condition in their original packaging.  Please note that you are responsible for the costs of returning the goods to us unless we delivered to you in error, or if the items are damaged or defective.  If we do not receive the goods back from you with the delivery slip, we may arrange for collection of the item from your residence at your cost.  We recommend you insure the return shipment as you are under a duty to take reasonable care of the goods and will be liable for damage to them until we receive them at our warehouse.  We also recommend you use a secure, trackable means to return your order to us at Village England, 46 Beaconsfield Rd, Twickenham, TW1 3HU and that you retain proof of sending, in case of dispute.

Please note you may only use your right to cancel the order under the Distance Selling Regulations if you give us formal written notice of cancellation any time after your order has been placed, up until 7 working days from the day after you received your order, as described above.

Returns

We hope that you will love your order! However, if you change your mind, returning a product is easy.  Just request a Return Merchandise Authorisation (RMA) number within 14 days of receiving your order and send the items back to use within 28 days.

To request an RMA, simply email us at [email protected] and confirm your order number and which items you would like to return. If an item is faulty, please give us some details as to the issue.  All refunds will be made to the original payment method used.  You will then receive an email containing your RMA.

Once you have received your RMA, simply complete the Returns pro forma invoice provided that you received with your order, and include it with your return so that we can process your refund promptly.

Goods are classified as faulty if they are received damaged, or where a manufacturing fault occurs within six months of purchase.  Please note that items that are damaged as a result of wear and tear are not considered to be faulty.  Faulty products will be assessed and if appropriate we will either refund you the value of the product and the original delivery charge, or action a replacement for which you will not be charged the additional postage. 

You must return your goods within 28 days of receiving them.  Any refund out of policy will be at the discretion of the Online team, and will normally be given in Store Credit to the value of the current selling price.

Exchanges

Please note we do not offer exchanges for alternative items, colours or sizes at our onlinestore. An Online exchange is placed as a new order. This will involve placing a new order and taking payment details from you again. You will be refunded for any returned item(s) in line with the policy stated above.

PROOF OF PURCHASE

Ordinarily if you have your receipt or delivery note we’ll refund the original debit, credit or charge card used to purchase.

Please note: Free shipping is not available on Sale items. Please also note that as we require deliveries to be signed for, we are currently unable to deliver to P.O. Boxes, BFPO’s and Hotels.

CHRISTMAS DELIVERIES
The last chance to order for guaranteed Christmas delivery is 12pm on the 22nd of December. For any orders placed after this date, we will do our level best, however delivery before Christmas is not guaranteed. Our warehouse will be close at 12pm on the 24th of December and will reopen on Friday the 2nd of January. All orders place at these times will be shipped on the 2nd of January and will be delivered to UK addresses before 12pm on the 5th of January.

Deliveries Outside of the EU – Duty

All orders are shipped from the UK. Deliveries outside the EU are subject to customs, legal, regulatory and certain practical restrictions. To comply with local legislation, you or the recipient may be required to pay additional taxes, fees or levies, import duty or other fees associated with formal customs entry when the good arrive in your country, before your local customs authority will release the goods to you. These are your responsibility. Please ensure that you enter the correct international delivery address and postcode. If the address is entered incorrectly or if customs duties or formal customs entry procedures are required, the delivery may be delayed. We are unable to offer you any assistance if either issue arises.

The charges outlined above must be paid by the recipient of the parcel. Where a customer fails or refuses to pay these charges, what happens to the goods is out of our control. In the event that the goods are returned without any charge to Village England we will refund the whole purchase price to the customer. In the event that the goods are returned to Village England but a delivery charge is levied on us, we will refund to the customer the purchase priceless the charge levied on us to return the goods.  It is possible that the goods will not be returned to us, in which case no refund of the purchase price will be given to the customer. In any event, goods that are returned due to the customer refusing or failing to pay any of the charges outlined in this paragraph will not be entitled to a refund of the delivery charge.  Customs policies vary widely from country to country, therefore you are advised to check the local requirements in your country when placing an order.

Delivery and Warranty Arrangements

Title will pass to you at the time payment is received by us in full.  Risk in any product ordered will pass to you upon dispatch of the product.

We deliver to all addresses in the UK, with the exception of the Channel Islands.   All orders will be dispatched subject to payment card authorisation and stock availability.

We will use our reasonable endeavours to deliver the goods or services within the times indicated. However, where delivery times and dates are given, they are for general guidance only and we will not be held liable for late delivery of goods caused by circumstances beyond our reasonable control.

You are responsible for making arrangements to receive the goods and if the goods are held at the post office or other delivery company’s depot because no one was available when the goods were delivered then it is your responsibility to swiftly collect the goods. It is important that the addresses supplied by you to us are accurate.

We will not have any responsibility for any loss or damage that occurs to the goods after delivery. A signature and confirmation of receipt constitutes completion of delivery.

Your order from the official Village England online store will be delivered to you in a branded Village England box. Please note that some bags and accessories are not provided with dust bags.  Please see the product descriptions for clarity.

Delays

Occasionally, the delivery of your order may be delayed. This can be for various reasons out of our control such as import delays or higher than anticipated demand. We will, of course, make every effort to keep you informed. Orders which have a different billing and shipping address may also be subject to delays whilst we perform additional credit checks.

Village England will not be held responsible for delays and cancellations where the data supplied by customer is incorrect or inadequate.

VAT Refunds

All total prices for goods and services at the checkout represent the total price payable by the customer for those items, regardless of the address for delivery. For deliveries to the EU, this price includes VAT (or VAT equivalent) at the current rate.  Orders that are to be delivered outside the EU may be subject to import duties and taxes that are levied once your order reaches your country and are not controlled by Village England.  VAT is zero rated on sales to customers outside the EU so the price payable is the full price and no VAT is payable.

COMPETITIONS

General Competition Terms and Conditions

Unless otherwise stated, all of the following Terms and Conditions Apply:

Prize draws and competitions are not open to employees (and their immediate families) of E & J Industries Ltd t/a Village England, their agents, or anyone connected with the competition or prize draw in question.

Only one entry per person. Collective and/or proxy entries are not allowed. Where applicable complete the webform or send in your paper entry form.

All prizes are subject to availability and Village England reserves the right to exchange them for items of equal or greater value.

Prizes are non-transferable and cannot be exchanged for cash.

Where applicable, paper entry forms must be on the official entry form in ink. Any damaged, defaced or illegible entry forms will be automatically disqualified.

All paper entry forms become the property of Village England and will not be returned.

No responsibility is accepted for any paper entry forms lost or damaged.

An independent person will supervise the competitions and prize draws. In respect of prize draws, the winner(s) will be drawn at random from all valid entries received by the closing date. In respect of competitions, the winner(s) will be the entrant(s) who, in the opinion of independent judge, complete(s) the skill-based task in the most apt, impressive and appropriate manner (the judge’s decision is final).

No correspondence will be entered into regarding the selection of the winner(s).

To request the name and county of the winner(s), please send a stamped self-addressed envelope to Village England Competition Winner, 46 Beaconsfield Rd, Twickenham TW1 3HU, UK after the date for selecting the winner.

The winner(s) agree to have their name(s) published as winner(s) and to take part in any publicity arranged by or on behalf of Village England in connection with the applicable prize draw or competition.

Prizes unclaimed after 60 days will be deemed to have been forfeited and Village England reserves the right to offer the prize to another entrant.

The prize draws and competitions are governed by English law and are subject to the exclusive jurisdiction of the English Courts.

Village England reserves the right to amend these terms and conditions at any time in its sole discretion. Village England shall notify any amended terms and conditions on its website.

By entering a prize draw or competition, each entrant agrees to be bound by these terms and conditions.

By entering a prize draw or competition, you agree to receive email communications from Village England with special offers, updates and promotions; we will not share your email address with any other 3rd parties.
